as I said in PM.. and I think i should post this here so that everyone knows. Life insurance is not a probatable asset. I/E - it is not considered part of your estate. SOOO your will or any other document will not direct the beneficiary of said insurance policy to distribute any of that money for expense purposes. If you have $0 when you die.. but you have an insurance policy.. the beneficiary of that policy gets the money. HOWEVER, the court can sue that beneficiary for the amount of money owed to the funeral home, last medical expenses, administration costs (executor fees and/or court costs), and then attorney fees.

Not sure about you, but I'd hate for my beneficiaries to have to pay for all that.

NOW.. If you have an IRA or CD or Annuities/securities.. then yes - those are Probatable assets that can be sold to pay for administration costs etc :D
